Terms and conditions of sale

Article 1 — Purpose and scope
These terms and conditions of sale (the "Terms") govern, without restriction or reservation, all sales made by Alo (the "Seller") to consumers and non-professionals (the "Customer") on the site alo-outlet-eu.shop (the "Site").
Placing an order on the Site implies unreserved acceptance of these Terms. The Customer declares having read them before confirming the order.
The Seller reserves the right to amend the Terms at any time. The Terms that apply are those in force on the date of the order.

Article 3 — Products
The products offered for sale are those shown on the Site on the day it is consulted, while stocks last.
Photographs, texts and descriptions illustrating the products are not contractual. Slight variations in shade or rendering may occur depending on the screen used and do not give rise to any liability on the part of the Seller.
Should a product become unavailable after the order is placed, the Customer is informed by email and refunded in full for that product within 14 days at the latest.
Article 4 — Prices
Prices are shown in euros, all taxes included, excluding delivery charges. Any delivery charges are shown before the order is finally confirmed.
The Seller reserves the right to change prices at any time. Products are invoiced on the basis of the rate in force when the order is recorded.
Article 5 — Orders
The Customer selects the products, checks the basket, enters delivery and billing details, then confirms the order and proceeds to payment.
Confirming the order constitutes acceptance of the prices, descriptions and Terms. The sale is complete only once the order has been confirmed by email and the price received in full.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over payment of a previous order, or where fraud is suspected.
Article 6 — Payment
The price is payable in full on the day of the order, by bank card or any other means of payment offered on the Site.
Payment data is transmitted encrypted to our payment provider. The Seller never stores card numbers.
Article 7 — Delivery
Products are delivered to the address given by the Customer when ordering. Shipments are made through trusted carriers (DHL, FedEx et UPS).
The indicative delivery time is 2 to 4 working days from order confirmation. A tracking number is sent by email as soon as the parcel is dispatched.
In accordance with article L216-1 of the French Consumer Code, if the delivery date is exceeded the Customer may terminate the contract after having instructed the Seller to deliver within a reasonable additional period, without effect.
It is for the Customer to check the condition of the parcel on receipt and, where appropriate, to raise any reservation with the carrier.
Article 8 — Right of withdrawal
In accordance with articles L221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt of the last product in the order to exercise the right of withdrawal, without having to give reasons.
As a commercial gesture, Alo extends this period to 30 days from the delivery date.
To exercise it, the Customer informs the Seller of the decision by an unambiguous statement sent to contact@alo-outlet-eu.shop. The practical arrangements are set out in our returns policy.
Products must be returned new, unworn, unwashed, in their original packaging and with their labels.
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the Customer's specifications or clearly personalised, nor to unsealed goods that cannot be returned for hygiene reasons.
Article 9 — Legal guarantees
All products benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
Under the legal guarantee of conformity, the Customer has two years from delivery of the goods to act, and may choose between repair and replacement. The Customer is not required to prove the existence of the lack of conformity during the twenty-four months following delivery.
Under the guarantee against hidden defects, the Customer may choose between rescission of the sale and a price reduction, in accordance with article 1644 of the French Civil Code, within two years of discovering the defect.

Article 10 — Liability
The Seller cannot be held liable for failure to perform the contract in the event of force majeure, an act of the Customer, or the unforeseeable and insurmountable act of a third party.
The Seller cannot be held liable for damage resulting from misuse of the products or from failure to follow the care instructions.
Article 11 — Personal data
The processing of personal data carried out in connection with orders is described in our privacy policy.
Article 12 — Intellectual property
All elements of the Site (trade marks, texts, photographs, logos, layout) are the exclusive property of Alo or its partners. Any reproduction, even partial, is prohibited without prior written authorisation.
Article 13 — Mediation and dispute resolution
In the event of a dispute, the Customer should first contact customer service at contact@alo-outlet-eu.shop in order to seek an amicable solution.
In accordance with article L612-1 of the French Consumer Code, the Customer may have free recourse to a consumer mediator with a view to the amicable resolution of the dispute with the Seller. The contact details of the competent mediator are provided on simple request to contact@alo-outlet-eu.shop.
The Customer may also use the European online dispute resolution platform at https://ec.europa.eu/consumers/odr.
Article 14 — Governing law
These Terms are governed by French law. In the event of a dispute not resolved amicably, the French courts have jurisdiction.
